Terms and Conditions

By clicking “Agree” or proceeding with payment, you confirm that you have read, understood, and agree to these Terms and Conditions. This agreement constitutes a binding contract between you (the “Member”) and Kate Morris Nutrition & Coaching PTY LTD (the “Company”).

Membership Term

The membership requires a minimum commitment of six (6) months from the date of registration.

After the initial six-month period, the membership will automatically renew on a month-to-month basis unless canceled in accordance with these terms.

Cancellation Policy

Members may cancel their membership by providing at least three (3) weeks' written notice prior to their next billing cycle.

Cancellation requests must be submitted in writing via email to katemorrispt@gmail.com

If a cancellation request is submitted before the six-month minimum term is completed, the Member remains responsible for the full six-month payment obligation.

Failure to provide the required three (3) weeks’ notice will result in the next billing cycle being processed.

Payment Terms

By agreeing to these terms, you authorise the Company to charge your selected payment method for the membership fees.

Membership fees will be charged on a recurring basis in accordance with the payment plan selected at registration (e.g., monthly, weekly continuation, or paid in full).

If a Member selects a paid-in-full option, the membership may automatically transition to a recurring payment structure after the initial term unless canceled in accordance with the cancellation policy.

It is the Member’s responsibility to ensure that their payment information is accurate and up to date.

Failed Payments & Late Fees

If a payment attempt fails due to insufficient funds or any other reason:

• The system will automatically retry the payment.
• On the third unsuccessful attempt (Day 5), a $10 late payment fee will be applied and added to the outstanding balance.
• If payment remains unsuccessful, a fourth and final attempt will be made.
• On Day 7, if payment is still not successful, access to the membership will be revoked.

Access will remain suspended until the full outstanding balance, including any applicable late fees, has been successfully processed.

The Company reserves the right to deny re-entry or terminate membership if payment obligations are not fulfilled.

Refunds

Membership fees are non-refundable and non-transferable.

Failure to use the membership does not constitute grounds for a refund, credit, or early termination of the agreement.

Intellectual Property

All content, materials, tools, and resources provided by the Company as part of the membership (“Intellectual Property”) remain the sole property of the Company.

Members are granted a limited, non-exclusive, non-transferable license to use the Intellectual Property solely for personal and professional use within the scope of the membership.

Services Not Provided by the Company

The Company, and its directors, employees, and agents, are not qualified to provide legal, tax, accounting, medical, or financial advice. Any information provided is for educational purposes only and is not intended as professional advice.

Limitation of Liability

The Company is not liable for any indirect, incidental, or consequential damages arising from the Member’s participation in the membership.

The Company’s total liability for any claim arising out of or related to this agreement is limited to the total fees paid by the Member during the applicable six-month term.
